Forensic Science (“Forensics” for brevity) applies scientific knowledge and methodology to legal problems and criminal investigations. The related term criminalistics refers more specifically to the scientific collection and analysis of physical evidence in criminal cases.
The analysis includes many kinds of materials, including blood, fibers, bullets, and fingerprints. Many law enforcement agencies operate crime labs that perform scientific studies of evidence.
Forensic scientists often present Expert Testimony (Testimony about a scientific, technical, or professional issue given by a person qualified to testify because of familiarity with the subject or special training in the field) to trial courts, as in the case of doctors, who testify on causes of death and handwriting experts who testify on forgery and fraudulent signatures.
The state government forensic science laboratories are generally loaded with a lot of analytical tasks to be performed. Since the private parties require the forensic analysis expeditiously, the legislature has created a provision as under:
a) Under Order XXVI Rule 9 of CIVIL PROCEDURE CODE, 1908, the Court may issue a commission to such person as it thinks fit directing him to make such investigation and to report thereon to the Court.
b) The Court can seek Expert Opinion u/s 45 of Indian Evidence Act, 1872.
